Please see below for the Terms and Conditions that apply to the services Harlem Cleaners, Inc. ("Harlem Cleaners", “we”, “us”, “our”) is providing for its customers (“you”, “your”). By using any of Harlem Cleaners's services, including but not limited to laundry and dry cleaning services, you acknowledge and agree to these Terms and Conditions (the “Terms”) as well as Harlem Cleaners's Privacy Policy. Please review the Terms and the Privacy Policy prior to using our laundry, cleaning, or any other offered “Services” for your items and products (as further detailed below).
Registration and Your Information:
In order to utilize the Services, you are required to register on Harlem Cleaners's website or application where you will submit your name, phone number and email address (and secondaries of each, if applicable), and credit card/debit card number (shared with and processed by third party payment service provider). Registration will not be completed unless you accept and agree to Harlem Cleaners's Terms and Conditions and Privacy Policy. You are required to ensure your account information is accurate and up-to-date. Failure to do so may preclude Services from being completed. Harlem Cleaners reserves the right to maintain records of your items submitted for Services, including pictures, receipts and other related records for any commercially reasonable purpose.
Services: Harlem Cleaners may utilize employees or third party service providers (“Personnel”) to complete any portion of the Services as determined in Harlem Cleaners's sole discretion. Notwithstanding anything to the contrary in these Terms or otherwise, Harlem Cleaners will not be responsible for any losses or damages caused by the acts or omissions of any such third party service provider. Harlem Cleaners assumes no responsibility for any items that you have not picked up after thirty (30) days. You understand and agree such items may be donated or otherwise used by Harlem Cleaners.
Submitting an Order: You can schedule your services through Harlem Cleaners's website or application, or contact us directly.
Payment: You will be charged for your use of the Services. Payment will be processed with the payment information you provided prior to delivery of your items. Harlem Cleaners MAY DELAY, RESCHEDULE, OR REFUSE DELIVERY OF THE PRODUCT IF YOU FAIL TO PAY IN FULL FOR THE SERVICES IN EACH INSTANCE. CHARGES WILL INCLUDE APPLICABLE TAXES. CHARGES ARE FINAL AND NON-REFUNDANBLE UNLESS OTHERWISE DETERMINED IN Harlem Cleaners'S SOLE DISCRETION. Harlem Cleaners may modify, add, or remove certain charges for Services as determine in its sole discretion. You agree that the minimum order on all Services provided by Harlem Cleaners before taxes is $25.00. In any instance in which the order amount before taxes is less than $25.00 you will be charged an additional fee equal to the amount required to meet the minimum price.
Pickup and Delivery: You will receive communications (e.g. text message (separate data rates may apply)) from Harlem Cleaners providing updates on the status of your order. If you leave your items unattended or with a third party prior to pickup, or Harlem Cleaners delivers items to a designated third party (e.g. doorman) or delivers to a residence, Harlem Cleaners is not responsible for such items’ loss or theft that may occur before pickup or after delivery. Personnel will take a picture of items at the time of pickup and delivery (showing the items that were delivered and where it was delivered).
Damaged Items: Harlem Cleaners strives to provide the best Services possible. However, Harlem Cleaners cannot guarantee against items being unaltered, including, shrinkage, such as shrinkage from improper manufacturer pre-shrinkage, fading, product breakdown from previous stain removal, item age, and darkening water stains. Harlem Cleaners also does not take responsibility for any deteriorated or faulty items that may be further damaged during the cleaning process. HARLEM CLEANERS, AS DETERMINED ABSOLUTELY IN ITS SOLE DISCRETION, MAY REIMBURSE YOU FOR A DAMAGED PRODUCT BUT SUCH REIMBURSEMENT AMOUNT WILL NOT EXCEED 2X’S THE AMOUNT YOU PAID FOR THE SERVICE REGARDLESS OF THE ITEM’S ORIGINAL COST OR BRAND. NOTWITHSTANDING THE FOREGOING, IF Harlem Cleaners FOLLOWS THE PRESCRIBED CARE INSTRUCTIONS FOR AN ITEM Harlem Cleaners WILL NOT BE LIABLE FOR ANY REIMBURSEMENT FOR SUCH ITEM. FURTHERMORE, NO CLAIM AMOUNTS WILL BE PAID UNLESS ITEMS ARE CLEARLY DIFFERENT AND DAMAGED FROM THE STATE THEY WERE IN WHEN PROVIDED TO Harlem Cleaners. FOR ANY DAMAGED ITEMS Harlem Cleaners REIMBURSES YOU FOR, Harlem Cleaners WILL KEEP THE DAMAGED ITEM TO USE IN ITS DISCRETION, INCLUDING DONATING TO CHARITY PARTNERS OR FOR TRAINING PURPOSES. Damaged item claims must be submitted to Harlem Cleaners at harlemcleaners@gmail.com within three (3) days of the date the item was picked up by or delivered to you.
Delicate Materials: Delicate and/or natural materials, including but not limited to silk, satin, leather, suede, wool, and certain materials are particularly sensitive and fragile. Certain products and foods may cause unremovable stains and manufacturer defects can also become apparent after cleaning. These types of items may also have issues due to natural defects in the material and can be sensitive to sunlight. Therefore, Harlem Cleaners may be unable to remove all stains from these types of materials or guarantee the item is unaltered after cleaning.
Lost Items: Claims for lost items must be submitted to Harlem Cleaners at harlemcleaners@gmail.com within three (3) days of the date an order was delivered or picked up or should have been delivered or picked up. HARLEM CLEANERS, AS DETERMINED ABSOLUTELY IN ITS SOLE DISCRETION, MAY REIMBURSE YOU FOR A LOST PRODUCT BUT SUCH REIMBURSEMENT AMOUNT WILL NOT EXCEED 2X’S THE AMOUNT YOU PAID FOR THE SERVICE REGARDLESS OF THE ITEM’S ORIGINAL COST OR BRAND. Harlem Cleaners does not take any responsibility for property left in pockets of items or bags when submitted for Services.
Limitation of Liability: IN NO EVENT WILL HARLEM CLEANERS, IT’S OWNERS, MEMBERS, DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, OR AGENTS BE LIABLE TO YOU FOR ANY INCIDENTAL, INDIRECT, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, LOST PROFITS, LOST SALES, LOSS OF DATA, OR LOSS OF GOODWILL, EVEN IF Harlem Cleaners WAS INFORMED OR KNEW OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES OR LOSSES.
Warranty Disclaimer: To the extent legally permitted, Harlem Cleaners's Services are provided “AS IS” without any express or implied warranties, including but not limited warranties of merchantability. Harlem Cleaners does not warrant or guarantee that Services will be completed without defect or that defects will be corrected.
Indemnity: You agree to indemnify, defend, and hold Harlem Cleaners, its owners, members, directors, officers, employees, contractors, and agents, harmless against any and all claims, costs, liabilities, suits or fees (including attorney’s fees) arising out of or related to your: (i) negligence or willful misconduct; (ii) breach of these Terms and Conditions; (iii) violation of applicable law; and (iv) Harlem Cleaners's use of information you provide in the course of Services.
Intellectual Property: All software, graphics, videos, and other content used, accessed, or otherwise made available in the course of the Services (“Materials”) are owned by Harlem Cleaners. Such Materials are protected by all applicable intellectual property laws, including those related to trademarks, copyright, and trade secrets. You agree to comply with such intellectual property laws during your use of the Services. You may not use, transmit, sell, decompile, reverse engineer, or otherwise distribute or break down any Materials unless authorized in writing by Harlem Cleaners in each instance. You may only use Materials for the limited purpose of using Harlem Cleaners's Services.
Access to Services; Communications: You are responsible for devices and network connectivity required to utilize the Services. Harlem Cleaners is not responsible for Service failures resulting from issues related to your devices and network connectivity. Harlem Cleaners may contact you at times to provide promotional information or other details related to the Services and any applicable agreements between you and Harlem Cleaners. You may opt-out of these communications at any time.
Modification: Harlem Cleaners reserves the right to modify these Terms at any time without prior written notice. Any and all modifications will be effective immediately upon posting on our website. Your continued use of our Services after Harlem Cleaners's posting of updates constitutes your agreement and consent to be bound by the Terms as amended. Please review the Terms in the future to confirm your understanding of your contractual relationship with Harlem Cleaners.
Governing Law: These Terms of governed by laws of the State of New York, notwithstanding any conflicts of laws principles, and you hereby consent to all claims and disputes related to the Services and this Agreement being submitted to the jurisdiction of federal or state courts located in New York, New York.
Notice: You may send notices to Harlem Cleaners at 247 West 87th Street, New York, New York 10024. Harlem Cleaners may send notice to you through the email address provided at registration or as otherwise updated by you. Such notice will be deemed sent and received twenty-four (24) hours after sent by email.
Miscellaneous: These Terms supersede any prior understandings or oral agreements between you and Harlem Cleaners regarding the Services, and these Terms constitute the entire understanding of the parties. There are no other agreements, understandings, representations, or warranties between the parties other than as set forth herein. In the event any portion of the Terms result in a violation of applicable law, such portion will be severable and the remaining provisions of these Terms will continue in full force and effect. Any failures or delays by Harlem Cleaners in insisting upon strict performance of these Terms, or asserting any of its rights and remedies as to any default or breach of the Terms will not constitute a waiver of any other default or of any such rights or remedies. All section headings in these Terms are included for convenience only and will not affect any construction or interpretation of these Terms.
Privacy Policy
We’ve developed this Privacy Policy with the goal to communicate how Harlem Cleaners is using and protecting our Clients’ personally identifiable information (“PII”), which is information that can be used to identify or locate an individual.
Type of Information Harlem Cleaners Collects:
In the course of our transactions with Clients, Harlem Cleaners may obtain a Client’s name, mailing address, e-mail address, credit/debit card information, birth date, phone numbers, or other information to complete a given transaction. This information is typically collected and processed by a third party payment company when Clients register with Harlem Cleaners or when orders are submitted or paid for. Harlem Cleaners does not store a Client’s credit or debit card information on its own internal systems.
How Client data is used by HARLEM CLEANERS:
When Clients submit PII to Harlem Cleaners, Clients are thereby agreeing to the terms of this Privacy Policy and expressly consent to the use and treatment of Client’s PII.
Harlem Cleaners may use the PII for the following business purposes:
To complete laundry, dry cleaning, or other services.
To respond to Client questions, feedback, or other inquiries.
To fulfill administrative needs.
To improve Harlem Cleaners's products and services.
To contact Clients for business and transaction purposes or for marketing communications purposes (unless Client has opted out of such marketing communications).
To assist with improving logistics, operational efficiencies, and client experience.
Harlem Cleaners does not sell Client information to third parties. In certain instances, Harlem Cleaners may share PII with third-party service providers performing certain business functions on our behalf (e.g. credit card payment processors, marketing vendors).
Harlem Cleaners may utilize cookies that are placed on your computer or mobile device when visiting Harlem Cleaners's website. Cookies can be either used to collect personal information or be personal information when combined with other information. Some cookies are utilized to help Harlem Cleaners's website operate correctly. Other cookies are used to track a Client’s online activity in order to enhance the user experience or for marketing or analytics purposes. You have the ability to decide whether to accept or reject cookies and can make updates to settings on your devices associated with cookies.
Security:
Harlem Cleaners maintains certain security measures intended to keep Client PII safe from unauthorized use or disclosure. However, no data that is processed and transmitted on the internet is guaranteed to be protected. All data processed by Clients on the internet is done at Client’s own risk. Harlem Cleaners is not responsible for third-party circumvention of any security measures or other privacy settings put in place by Harlem Cleaners or a third party service provider.
Information is kept indefinitely by Harlem Cleaners. You can contact Harlem Cleaners at harlemcleaners@gmail.com to request your information be deleted from Harlem Cleaners's files.
Third-Party Sites:
To the extent Harlem Cleaners's website links to any third party website, such third party websites will have their own privacy polices and Harlem Cleaners is not liable for such privacy policies or any activity on third party sites.
Harlem Cleaners may modify this Privacy Policy at any time by updating and posting on our website.
